Valuation

Valuation

 
Davis Brown undertake most types of valuation and have Registered Valuers who specialise in Red Book valuations. These valuations are carried out in accordance with the RICS Valuation Standards. This is currently referred to as the "Red Book".  We are registered under the Valuer Registration Scheme and are subject to monitoring by the Royal Institution of Chartered Surveyors (RICS). Normally, the valuations are based on "Market Value" but there are other values including "Worth" and "Fair Value" which can be provided if required.
 
We undertake mortgage valuations for various funding institutions, banks and building societies.
 
We undertake Section 18 valuations on behalf of either landlords or tenants.  Any terminal dilapidations claim cannot exceed the amount by which the disrepair diminishes the value of the property.  This is commonly called a Section 18.
 
valuation under the Landlord & Tenant Act 1927.  Section 18 only deals with the landlord's claim for the failure to carry out repairs and does not cover other breaches such as reinstatement and redecoration.  The valuation involves assessing the value of the property in its existing condition and the value of the property had the lease covenants been performed.
 
We carry out valuations for Capital Gains Tax and Inheritance Tax purposes, the latter often referred to as Probate.  These reports are often submitted to HMRC.  In the event of a dispute, we can represent clients at the Upper Tribunal (Lords Chamber) or Higher Courts.  There are various assumptions which must be made when undertaking these valuations which differ slightly from the definition of Market Value.

LPA Receivership

LPA Receivership

 
We have surveyors who are members of The Association of Property Fixed Charges Receivers (NARA).  Surveyors  employed by or who are consultants to Davis Brown are often appointed by banks to act as LPA Property Receivers which are different from Administrators.
 
The LPA Receiver is appointed under the terms of a fixed charge or mortgage deed.  The Receiver is generally the agent of the borrower and powers extend to inter alia collection of rent, securing/repairing/insuring the property, organising the letting and/or sale and repaying any surplus to the borrower after fulfilment of the loan.

Our building surveyors have cumulative experience of more than 50 years professional practice. We are happy to accept instructions for small, medium or large scale properties of any type throughout the country. We have wide experience of surveying modern as well as period and historic properties. Our director of building surveying is a past winner of the Henry Stewart Structural Survey prize.
One of the core skills of building surveyors is to prepare specifications of building works. Our building surveying team is well versed in this discipline, routinely dealing with maintenance and repair works, alteration and refurbishment schemes in all property types. 
 
Our building surveyors have a wealth of experience in acting as contract administrators under a broad range of building contract types and in respect of building works in a variety of buildings including commercial, industrial and residential property. We are happy to undertake this role for small, medium or large projects with contract values in excess of £1,000,000.
 
We are experienced practitioners in relation to schedules of dilapidations and schedules of condition. We act routinely for landlords and tenants in preparing and negotiating schedules of dilapidations countrywide. We have handled claims ranging from those in the tens of thousands of pounds to multi-million pound claims and have the ability and are experienced at acting as expert witnesses in court proceedings or in relation to mediation or other forms of alternative dispute resolution. We are experienced at preparing detailed schedules of condition either in relation to landlord and tenant matters, in connection with party wall procedures or otherwise.
 
Davis Brown’s building surveying team are experienced at producing building reinstatement cost assessments. Our knowledge and experience covers all property types and locations throughout the country. We regularly provide portfolio valuations for a number of landed estates and property companies as well as for properties we manage “in-house” for management clients.
 
We are able to offer comprehensive assistance to clients in preparing planned maintenance reports. Our reports may be focused on a single property or a portfolio of properties as a tool for forward planning of expenditures on property assets. Where required, we are able to develop the planned maintenance reports into detailed specifications and carry through works projects to successful completion.
 
Davis Brown’s building surveying team are experienced project managers taking a leading role in a team of construction professionals. As project managers, we will assist in the selection and appointment of architects, engineers and other professionals as part of an overall design and procurement team. We can provide valuations for lease extension, enfranchisement or collective enfranchisement for either lessors or lessees.  The Leasehold Reform Act 1967 covers enfranchisement of houses and the Leasehold Reform, Housing & Urban Development Act 1993 as amended by the Commonhold & Leasehold Reform 2002 deals with lease extensions and collective enfranchisement of flats.
 
These are complex valuations and there have been a number of Lands Tribunal, Court of Appeal and House of Lords case over recent years with regard to some fundamental issues including Hope Value, Development Value, Deferment Rates and Relativity.
